General terms and conditions

1. GENERAL

Welcome to our website WWW.ZILTON.COM (hereinafter called “ZILTON.COM” or “webshop”).

The website ZILTON.COM is operated by Taberna with offices in Belgium at 's Gravendreef 24, 9810 Nazareth with as phone number +32 93 10 31 80 and as VAT number: BE 0790 219 408 (hereinafter called "Taberna" or “we”).

These general terms and conditions govern all use of ZILTON.COM and in particular the product offers and sales on this website. When you visit this website or buy a product on it, you agree to be bound by these terms and conditions. Please note that these terms and conditions may be updated from time to time so we recommend that you read them carefully each time you visit us. Taberna does not accept any other terms and conditions unless we have agreed otherwise in writing.

2. PRIVACY

In our privacy policy, you will find information on how Taberna will use your data. By accepting these terms and conditions, you also agree with our privacy policy.

3. RIGHT TO REVOKE YOUR ORDER

The consumer has the right to inform ZILTON.COM that he or she wants to renounce the purchase within 14 calendar days after receipt of the order, without having to pay a penalty or stating the reasons. If you exercise the right of withdrawal, you must return the goods received as soon as possible and no later than 14 days after you have informed us of your decision to withdraw from the purchase. The federal government provides a model form to indicate your wish to cancel. However, at Zilton you do not need to use this, we make returns very simple. Below you can read more about the various return options.

4. RIGHT TO RETURN YOUR ORDER

You have the right to return your items that you have bought within 30 calendar days. This period begins the day of your reception of your parcel. Return requests will not be accepted after this period.

4.1. Returning your items in a Zilton store

You can choose to return the items in our Zilton store in Ghent, Belgium. Please return your items within 30 days after receiving your parcel to the Zilton boutique of your choice.

For the value of the items you are returning, you will be refunded in the boutique using the payment method you used for the original purchase.

4.2. Return via a Bpost parcel point or locker (Belgium)

Put your trousers(s) in the original box and stick your return label over the old one. You will find the label in the envelope inside your parcel. Drop off your parcel at a Bpost parcel point near you. Or go to a Bpost parcel locker: scan the barcode on your parcel, place it in the locker and close the door. Find a Bpost drop-off point near you on bpost.be/en/points-of-sale

Please keep your return receipt or return e-mail from Bpost in a safe place. We’ll confirm receipt of your return shipment by email. You can also track the status of your return using your Zilton.com account. Refunds for returns via Bpost will be made within 15 days following receipt of your package

At the Zilton store

Bring the articles you want to return back to the Zilton store in Ghent. You will find all information about the store at zilton.com/en/stores.

At a Bpost drop-off point

Put your trousers back in the original box and stick the new, returns label on top of the old one. You will find the returns label in this envelop. You can drop off your package at any Bpost parcel point or post office in your neighbourhood or go to a Bpost parcel locker: scan the barcode on your package, put it in the locker and close the door.

4.3. Our conditions

We ask you to take note of the following:

Please return items within 30 days after receiving your parcel.

Please understand that we cannot take responsibility for any packages that are not returned using our returns service.

Please only return items in unused and undamaged state.

Please return your items with the original tags and labels, which should be in perfect condition and attached to the item.

Please include the original, undamaged packaging.

Vouchers cannot be exchanged for cash. If the initial order was paid for using a voucher, a new voucher will be issued when the item is returned.

Please note that returned products may only have been tried on or tested for their proper functioning. After all, products that were not only tried on/tested but also used, can lead to a compensation fee for potential depreciation.

Refunds will be issued within 15 days of receipt of the returned item.

In the case that you have paid shipping costs for your order, your originally paid shipping costs will also be refunded in the event of a full return of said order.

Please note:

If we cannot process your exchange or refund because the above conditions are not met, you will be notified by our customer service team. Returns that were not accepted can be re-sent to you after depositing an €18 shipping and handling fee within 10 days. In case you don't want to receive your items back, we are obliged to cancel them.

In the exceptional case that your package is lost during shipping or return, you will always be refunded with a voucher. It is not possible to refund this amount in cash.

Important general remarks:

Potential losses due to currency fluctuations will not be refunded. You will find additional useful information for returning products in the returns section of the Customer Care pages. If you do not find the information you are looking for, please contact our customer care team.

Either party has the right to cancel a purchase in the case of significant infraction of these conditions by the other party. For example, this means that we can cancel a purchase if you are not a customer or if we have reason to believe that your payment is not legally valid. Taberna reserves the right to adjust or cancel an order if prices or reductions are not correctly displayed on the website or if they are not correctly stated on the invoice.

5. LEGAL GUARANTEE

The information listed in (4) does not in any way affect the guarantees provided under Belgian law in the case of a defective item. We request that you inform us that your item is defective within two months. Complaints received later than this will not be accepted.

6. PRODUCT INFORMATION

We have made every effort to make sure colours and descriptions of our products are as accurate as possible. However, please be aware that the image and colour quality may vary depending on your screen and that we cannot guarantee that your screen accurately reflects all characteristics of the actual product.

You will find a product description (colour, size, type of product, etc.) and digital photographs with each product. All prices include VAT for European countries but exclude delivery costs. Prices may change. Please check the applicable price advertised at the time you place an order.

In case of any faulty item with your order, please contact our customer care within the week of your delivery so the warehouse is informed.

7. ORDERS

ZILTON.COM only sells its products to consumers. This means that if you are an individual who intends to buy a product not for personal use but, for example, for resale or if you are a company, you cannot place an order and we will not sell you our products. A binding sale between you as consumer and ZILTON.COM as seller, governed by these terms and conditions, is concluded when you place an order on this website. Your order shall be deemed placed when you completed the final step of the order process.

By submitting an order, you explicitly agree to be irrevocably bound by these terms and conditions, including all policies and subsections such as the Privacy Policy and return sections.

In the unlikely event that a product that you ordered is not available, we will inform you promptly and propose an alternative solution (for example: later delivery, exchange, refund) without any cost to you.

Taberna reserves the right to adapt or to cancel an order in case prices or discounts were not displayed correctly on the website or in case they were not stated correctly in the invoice.

8. PAYMENTS

After you submit your order, you will be referred to the secure payment page of our website and will be requested to pay for your order.

We accept MasterCard, Maestro credit and debit cards, Visa and Bancontact.

You will receive an electronic order confirmation on your screen and per e-mail when your payment has been made. Your credit or debit card payment will be charged at the moment of purchase.

By paying the order, you authorise Worldline (WORLDLINE N.V., Haachtsesteenweg 1442, B-1130 Brussel, Belgium) to store your financial details in a secure way, so you will not have to enter them again for future orders on ZILTON.COM.

In case of a refund, we will credit the card or bank account of the person who paid for the product(s). We are not responsible for fluctuations between the currency used for the initial payment and the currency of your credit card or bank account when the refund is made.

9. DELIVERY AND SHIPMENT

You can choose how you wish your order to be delivered:

  • Delivery at your home or other address via Bpost
  • Delivery in the Zilton store in Ghent
  • Delivery in a Bpost parcel point or locker (Belgium)

9.1. Delivery at your home or other address via Bpost

As soon as your order is shipped, you will receive an e-mail indicating your order tracking number and a link to the Bpost website. With this service you can track your order at any time.

At the moment of delivery, responsibility for your purchased item(s) passes to you. If you are not the receiver of your purchase (for example a gift order) then the person who signs for the package confirms receipt and is accountable for the package. If the parcel bears any sign of damage upon delivery, please contact our customer service directly.

Please be aware that we cannot deliver to post office boxes.  We are unable to redirect orders once your purchase has been completed.

If you are not present to take delivery of your parcel, the carrier will leave a calling card informing you how to rearrange your delivery. We are unable to redirect orders once items have been dispatched.

Delivery is organised from Monday to Friday, from 9 AM to 5 PM, except on bank holidays.

9.2. Delivery in our Zilton store

When completing the purchase form, you can select the possibility of having your trouser(s) delivered to our Zilton store in Ghent, Belgium. Upon receipt of your delivery request, we will be sending you a confirmation of your request. Upon receipt of your pieces in the selected Zilton store, we will be informing you by mail. Please visit the selected Zilton boutique within 10 days, with your order confirmation, printed or on your smartphone.

9.3. Delivery in a Bpost parcel point or locker (Belgium)

You can choose to have your items shipped to a Bpost parcel point or locker of your choice in Belgium.

Once your order has been placed, we will send you a confirmation email containing all the necessary details such as the address of your selected pick-up point and a tracking code. With this tracking code you can follow your parcel whenever you like.

Once your order is ready to be picked up, you will be informed by email. Your order will be available for 14 days in a Bpost parcel point or 5 days in a parcel locker. In case you haven’t picked it up, you will receive a reminder email.

We kindly ask you to bring your identity card when picking up your parcel.

9.4. Shipping costs & countries

We are able to take payments from and deliver to the following countries. The shipping cost is € 4.99.

We aim to ship all orders within 3 working days after receipt of payment. Estimated delivery times are to be used as a guide only. We are not responsible for any delays caused by destination customs clearance processes.

10. INTELLECTUAL PROPERTY

All content (images, text, trademarks, …) on ZILTON.COM is copyright and trademark protected.

It is not permitted to use, reproduce or distribute content from this website without the express written consent of ZILTON.COM.

11. GIFT VOUCHERS

Vouchers are subject to the following terms and conditions:

Gift vouchers are valid for 12 months from date of purchase.

Vouchers can be redeemed against items on WWW.ZILTON.COM or in the Zilton boutiques.

Vouchers are nontransferable and may not be returned or redeemed for cash.

If the order amount exceeds the gift voucher amount, please select the payment method with which you wish to cover the amount remaining.

If the gift voucher amount exceeds the order amount, you may use the same code for your next purchase. The amount remaining shall be available until your credit balance has been used up completely or the expiry date of the voucher.

For returns that were purchased by gift voucher, a new gift voucher will be issued.

Gift vouchers will be emailed to the recipient once the full order has been processed and payment has been taken. Upon demand of the sender, a copy can be sent as confirmation of dispatch.

ZILTON.COM is not liable for delivery of a Gift voucher to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.

ZILTON.COM is not responsible if a Gift voucher is lost, stolen, destroyed or used without permission.

ZILTON.COM reserves the right to cancel a Gift voucher if we deem such action necessary.

Sales tax and shipping is applicable on any products purchased with a Gift voucher.

Promotion voucher codes or Gift vouchers cannot be applied to the purchase of Gift vouchers.

Promotion voucher codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other voucher code or offers, and must be redeemed by the date published, if provided.

12. COPY OF CONTRACT

Taberna keeps an electronic copy of your order for as long as is required by law. If you wish to have a hard copy of your order, you can print the "order confirmation" that will appear on your screen once you have submitted your order and your payment has been processed. This order confirmation will also be sent to you by email. For additional copies, please contact us.

13. APPLICABLE LAWS - JURISDICTION

This agreement between you and Taberna is governed exclusively by the laws of Belgium.

The Courts of Antwerp, Belgium and, if you are a citizen of the European Union, the courts of your place of residence will have exclusive jurisdiction.

If a provision of these terms and conditions is invalid, the validity of the remaining provisions shall remain unaffected.

Possibility for online dispute resolution:

The European Commission offers the possibility for Online Dispute resolution on one of their online platforms. This platform can be accessed via the external link https://ec.europa.eu/odr/.
